It had to happen: Apple sued over iPhone price discrimination

iphone.jpgI wonder if anyone was taking bets on who would file a legal lawsuit against Apple for their price cut on the iPhone.

Dongmei Li of Queens, New York City is accusing Apple of "price discrimination, underselling, discrimination in rebates, deceptive actions, and other wrongdoings."

Apparently, Li purchased a 4GB model of the iPhone and is upset that she can no longer resell her purchase for the same profit that someone who bought one after the price drop. She's also upset that her phone has already been discontinued.

It would seem that losing money over this is a big problem for you. Then why buy the iPhone in the first place? You bought it because you believe the hype and you want to be one of the very first customers to buy it off the shelves on opening day. Now you are angry that Apple does a price cut on the phone.

Yep, you could have saved yourself about $200 if you waited a few months. But it was your own individual choice to buy it on the first day. Do not blame Apple, blame yourself.

Same goes when the XBox came out, then the XBox 360, the PS3, and so on and so forth.

So, companies aren't allowed to lower their prices anymore?
What the hell did Apple do that could possibly be seen as illegal?

I couldn't agree more.Early adopters of technology have two things to think about as they wait in line for 6 hours(or more!!) to buy their gizmo:
1)First generation hardware almost always has technical problems/oversights.
2)Price drops are inevitable.

I have no sympathy for people who fail to realize these things in their rush to be the first kid on the block with a new toy.I have even less for people who only buy the items so they can resell them on eBay for some ridiculous,overinflated price.

1 million dollars because of a 200 dollar price drop? I'll bet she bought a couple to sell and now she'll be losing money.
IMHO Apple responded quickly and fairly once Steve Jobs understood there were customers that weren't happy. How many companies do that?
Apple offered a 100 dollar credit with Apple and ATT/Apple offered 200 dollars back if you bought the phone within 14 days of the price drop(4gig or 8gig).
Did anybody sue when the prices were lowered on the game stations like xBox, Playstation, etc?

Oh, I bought a TV a few years ago, and the price is different now, can I go ahead and sue the TV manufacturer for dropping prices? Can all the people who bought Plasma TVs for 7000$ when they first came out sue for damages?

This is by far the most ridiculous lawsuit, even more so then the one of the missing pants. There are no grounds what so ever for her to sue. I think she is just looking for a way to get rich quick without having to bother working for it.

First of all, I just have to say are you freaking joking. All of the legal issues aside, in what possible reality does a $200 price cut equal to $1 million dollars compensation? This woman is smoking crack and just highlights the problem with a legal system that even considers such a frivilous lawsuit. I mean come on people, are we really going to reach the point where we have to legislate 'common sense' rules about lawsuits. This level of stupidity is why we have labels on toasters to the effect of 'Do not use in water'.

This woman should be laughed out of the courtroom and immediately arrested upon entering the hallway for frivilous litigation. I personally am a tech junkie and an early adopter and anyone who is understands that a premium comes with being the first one to have the latest and greatest. Frankly, IMHO this sounds like a case of one of creeps out there who goes out to buy up supplies on the next big thing hoping to turn around and sell it on EBay for 5 times the going price. She says it herself, "I won't be able resell it for as much as those who bought it after the price cut." Who buys a cell phone only to immediately turn around and resell it? Well too bad Dummy, you got burned for $200 this time around. There is nothing illegal about a company cutting its prices to drive sales.

Oh and the shyster who took this case must be like Kramer's lawyer from Seinfeld. He or she is obviously one of those lawyers that gives people a reason to tell lawyer jokes.

What's next? Suing a company because their stock dropped in value? This lady is such a LOSER.

When there is a new model of this, we do not let ourselves repent for not buying this new one, instead we grab the opportunity to get this latest iPhone.
